Terms & Condition

Booking and Payment

1. A non-refundable booking fee of 85% is required to secure your session date.

2. The remaining balance must be paid not later than a week before the event/session date unless otherwise agreed in writing.

3. Bookings are confirmed only after the deposit and signed agreement are received.

4. The booking fee is deducted from the total cost of the package.

Cancellation and Rescheduling

1. Cancellations made by the Client less than 3 days before the session will result in forfeiture of the booking fee.

2. Rescheduling requests must be made at least a week in advance and are subject to availability.

3. If the Photographer cancels due to unforeseen circumstances, a full refund of any payments made will be issued, or an alternative date will be offered.

Session and Coverage

1. The Photographer will provide services at the agreed location(s), date, and time.

2. The Client is responsible for ensuring that all individuals to be photographed are present and prepared at the scheduled time.

3. The Photographer is not responsible for missed shots due to lateness, uncooperative behavior, or restrictions imposed by the venue.

Copyright and Usage Rights

 1. All images remain the copyright property of 26LENS.

2. The Client is granted personal use rights to print and share images but may not sell or edit the images without written consent.

3. The Photographer reserves the right to use images for portfolio, website, social media, and promotional purposes unless otherwise agreed in writing.

Image Delivery

1. Edited images will be delivered within the agreed date after the session date unless stated otherwise.

2. Delivery will be made via online gallery, flash drive, or preferred medium.

3. The Photographer retains discretion over which images are selected and edited.

4. Raw (unedited) images will not be released under any circumstance.

Editing and Retouching

1. Basic editing (color correction, exposure adjustment, cropping) is included in all packages.

2. Extensive retouching (e.g., body modification, object removal) may attract additional fees.

3. The Photographer’s editing style is consistent and final; requests for re-editing may incur a charge.

Liability

1. The Photographer will take all reasonable measures to produce quality images.

2. In the unlikely event of total equipment failure, loss, or injury beyond the Photographer’s control, liability is limited to the refund of all payments received.

3. The Photographer is not liable for damages caused by circumstances outside their control (e.g., weather, venue restrictions, or accidents).

Client Cooperation

1. The Client agrees to provide a safe and respectful environment during the session or event.

2. The Photographer reserves the right to discontinue coverage or leave an event if there is harassment, unsafe conditions, or unlawful activity.

Storage and Archiving

1. Final images are stored for a year after delivery.

2. Re-delivery requests after this period may incur additional fees or may not be possible if files are no longer archived.

Governing Law

These Terms and Conditions shall be governed by and interpreted according to the laws of Lagos, Nigeria and both parties agree to submit to the jurisdiction of its courts.

Agreement

By booking a session or making payment, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
